1. Introduction
Welcome to Creativa! These terms and conditions govern your use of our website and the services provided by us. By accessing our website or engaging our services, you agree to comply with these terms and conditions in full. If you disagree with any part of these terms, please refrain from using our website or services.
2. Services Offered
Creativa offers a range of graphic design, multimedia design, video content creation, social media design, and brand design services. These services are provided subject to the terms outlined below.
3. Payment Terms
Clients agree to pay Creativa for services rendered according to the agreed-upon pricing structure. Payment methods accepted include bank transfer or PayPal. Invoices will be issued after the contract is signed and are due upon receipt.
4. Intellectual Property
All designs, content, and materials created by Creativa remain the intellectual property of Creativa unless otherwise agreed upon in writing. Clients are granted a non-exclusive license to use the designs and content for their intended purposes upon full payment of all fees.
5. Client Responsibilities
Clients are responsible for providing necessary materials, feedback, and approvals in a timely manner to facilitate the completion of projects. Failure to provide required materials or feedback may result in project delays and additional charges.
6. Project Scope
The scope of work for each project will be outlined in the initial proposal or agreement. Any additional work requested outside the scope of the agreed-upon project may incur additional charges.
7. Cancellation and Refund Policy
The Client retains the right to cancel contracted services within seven working days of agreement, subject to the following provisions. A working day is any day other than weekends and bank or other public holidays.
7.1 Exercising the Right of Cancellation:
As stipulated in clause 7, the Client must provide written notice to the Graphic Designer by hand, post, or email to exercise the right of cancellation.
7.2 Refund Process:
Upon receiving notice of cancellation, the Graphic Designer will refund the Client any upfront payment made for the Services within 30 days, deducting any reasonable costs incurred by the Graphic Designer before receipt of the notice.
7.3 Post-Cancellation Period:
Following the seven-day notice period as outlined in clause 7 any upfront payment for services will not be refundable unless the Graphic Designer fails to provide the deliverables for the relevant Services. In such a case, the Client may provide seven working days’ notice to terminate. However, the Client's dissatisfaction with the deliverables or decision not to use any or all elements of the Services shall not be considered a failure to deliver, and the fee shall not be refunded.
7.4 Third-Party Responsibility:
The Graphic Designer is not responsible for any product or service from any third party and will not offer any refund or cancellation on behalf of any other businesses involved in this project.
7.5 Termination of Services:
Termination of the services under the Contract will not affect either party’s outstanding rights or duties, including the Graphic Designer's right to recover any money owing under these terms and conditions.
8. Liability and Disclaimers
Creativa shall not be liable for any loss, damage, or delay arising from errors, omissions, or technical issues beyond our control. We make every effort to ensure the accuracy and quality of our work but cannot guarantee specific outcomes or results.
9. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Updates to Terms
Creativa reserves the right to update or modify these terms and conditions at any time without prior notice. Changes will be effective immediately upon posting to our website. It is the responsibility of clients to review these terms periodically for any updates.
